Amazon has secured a victory before the EUIPO, with its opposition fully upheld and a contested trademark application rejected in its entirety over likelihood of confusion with the 'AMAZON' mark. The ruling found the goods identical and the signs sufficiently similar —particularly in structure and initial lettering — to mislead consumers, even with minor spelling differences. Emphasizing the principle of imperfect recollection, the panel concluded that average consumers could assume a shared commercial origin, reinforcing Amazon’s strong defensive posture in protecting its brand across European markets.
