Skechers Files Patent Infringement Lawsuit Against Rockport’s Parent Companies
Sep/16/2024Skechers is taking legal action against Marc Fisher Holdings and Authentic Brands Group, accusing them of patent infringement related to Rockport’s Tristen Step Activated Slip-On shoes. According to a complaint filed in the Southern District of New York, Skechers claims that Rockport's design mimics its slip-in patent, particularly a unique heel construction that simplifies foot entry. This lawsuit is part of a broader pattern of Skechers defending its design innovations through legal channels.
In its complaint, Skechers contends that the Rockport shoes in question unlawfully copy key aspects of its slip-in design, which features a specialized heel structure allowing for easier foot entry. The Tristen Step Activated Slip-On shoes, designed by Marc Fisher Holdings and sold under the Rockport brand, are at the heart of this legal dispute. Skechers' slip-in design has been the focus of multiple legal battles, including a 2022 suit against nonslip shoe brand Laforst, which was ultimately settled. This latest legal action follows Skechers’ established pattern of aggressively defending its intellectual property in the footwear industry. As shown in the first visualization, Skechers has been particularly active in defending its intellectual property, filing numerous trademark opposition cases in the U.S. in 2024. The company's aggressive stance underscores its commitment to protecting its brand and product designs in an increasingly competitive footwear market.
Authentic Brands Group, which acquired Rockport following the latter's bankruptcy in 2023, oversees the brand through a licensing partnership with Marc Fisher. Together, the two companies have been driving Rockport’s design and retail operations. Skechers, meanwhile, is seeking a jury trial and damages for the alleged infringement. The slip-in design at the center of this dispute has been heavily marketed by Skechers, with high-profile campaigns featuring celebrities like Martha Stewart and Snoop Dogg. Adding to its proactive approach, Skechers also continues to expand its trademark portfolio. The second visualization highlights its recent trademark filings in the U.S. from August 2024, which include "AERO SONIC" and "AERO ACCELERATE" for footwear products. These filings signal the company’s strategic focus on innovative designs and branding as it seeks to maintain a competitive edge in the fast-paced footwear industry.
