Netflix Prevails in EU Trademark Dispute After Appeal

A ruling by the EUIPO Opposition Division has partially upheld Netflix’s challenge against a figurative trademark application filed by a Barcelona-based applicant, overturning an earlier decision that had dismissed the streaming giant’s claims. The dispute, grounded in Netflix’s well-known 'NETFLIX' word mark and related registrations, was revived after the Board of Appeal found that additional evidence concerning the brand’s reputation and distinctiveness should be considered. Following the reconsideration, EUIPO concluded that the contested mark could create a likelihood of confusion for several categories—including audiovisual devices, paper goods, clothing accessories, online retail and advertising services, and publishing activities.
