Amazon has been hit with a record $39 million fine by the Delhi High Court after being found guilty of “deliberate and willful infringement” in a trademark dispute with Beverly Hills Polo Club (BHPC). The lawsuit, filed in 2020 by Lifestyle Equities, the brand’s owner, accused Amazon of selling apparel under its in-house ‘Symbol’ brand featuring a near-identical polo player logo to BHPC’s. The court ruled that an Amazon-affiliated seller, Cloudtail India, marketed the infringing products, and despite Amazon’s attempts to shift blame, the court held Amazon Seller Services accountable. Justice Prathiba M. Singh condemned Amazon’s “deliberate strategy of obfuscation,” stating that the company hid behind multiple roles—as an intermediary, retailer, and brand owner—to avoid liability.
